Massachusetts OUI Fifth Offense Laws & Penalties (5th)
If you've been arrested and are facing a a fifth (5th) Offense
OUI charge in Massachusetts, you know you are facing a very serious charge. If
you are found guilty, you will serve a minimum of 2 years in jail, mandatory. You
absolutely must have a very experienced OUI defense lawyer who knows how to fight and win a
Massachusetts OUI/DUI
trial. You are facing a felony charge with a mandatory jail sentence if
convicted. It's quite possible to be charged with a fifth offense
even if you've never faced a felony charge before. The State can still count
decades old offenses against you as priors, even if the charges were treated far
less seriously then, than they are today. The penalty for a fifth offense OUI in Massachusetts includes:
- A jail sentence of not less than 2 1/2 years in jail (2 years must
be served, mandatory), and not more than 5 years in State Prison (a
felony)
- Fines up to a maximum of $50,000
- License suspense for life; No hardship license available
I've successfully fought and won many multiple offense cases before, and
I know what it takes to beat them. In fact, I win my trials more than 2/3s of the
time. The only way you are likely to avoid going to jail for this charge
is to fight and beat you OUI at
trial. Please call me to talk
about your case. I'll tell you about my experience in similar cases, and what I
can do to protect your rights and freedom. An attorney who doesn't handle
multiple offense Massachusetts OUI cases frequently may
not be familiar with all the procedures and laws that can be used in your
defense. When facing a fifth offense drunk driving charge / DUI/ OUI, there's no
question that need a very experienced MA OUI attorney to give you the best
chance to prevail.
If you are facing a Felony Massachusetts Multiple Offense Drunk driving/
DUI DWI / OUI charge, you know you need an
experienced DUI lawyer to defend your rights and protect your freedom.
