Cross Examination during a Massachusetts DUI Trial

Finger to Nose Test (also known as the Rhomberg Modified test).

The Finger to Nose test  is a standard field sobriety test that is considered scientifically questionable in determining alcohol impairment, yet it is commonly given by Massachusetts police in DUI stops. Correlation between being able to perform this test and being driving impaired is little better than chance..

 

Some Sample Finger to Nose Test questions:

You also administered a finger to nose exercise? 

During the finger to nose, you had him close his eyes?

When you had him close his eyes, you cut off any visual balancing ability?

You also told him to tilt his head back?

When you told him to tilt his head back, you disrupted the vestibular system, or fluid, in his inner ear?

Let me make sure I understand this, you told him to close his eyes, tilt his head back, and you noticed sway?

You cut off the two systems by which the body maintains balance and you noticed sway?

The finger to nose has never been validated by NHTSA as a reliable indicator of blood alcohol concentration, has it?

Would you have a basis to disagree that, according to NHTSA scientific research, the finger to nose has been shown to have a 50% correlation to a blood alcohol concentration of 1.0 or greater?

You could toss a coin with a guaranteed predictive validity of 50%, couldn't you?

Heads he's sober - tails he's drunk?

He was able to put his heels together.

He was able to tilt his feet out at a 45-degree angle.

You asked him to shut his eyes and he shut his eyes.

You asked him to tilt his head back and he tilted his head back.

You asked him to put his arms out and he put his arms out.
