Cross Examination during a Massachusetts DUI Trial

Police Report

This line of questioning establishes the police report as the definitive document of record as to the facts of the case.  There are many reasons for this, including for anything not written in the police report, the defendant can be assumed to have done correctly or normally, e.g. "If he had fumbled for his wallet, would you not have noted it in your police report?"

Some Sample Police Report cross examination questions:

You prepared a report in relation to this matter?

That report is complete and accurate?

Your report in relation to this matter contains all of the important facts?

A report lacking in important facts will make it more difficult for the government to achieve a conviction?

You consider yourself a professional when it comes to preparing police reports?

Your report in relation to this matter was prepared after you had decided to arrest my client on these charges?

Your report in relation to this matter was prepared from notes that you took in the field?

Do you consider this report to be complete and accurate?

You are trained to note purported signs and symptoms of alcohol consumption in your complete and accurate report?

Noting purported signs and symptoms of alcohol consumption facilitates OUI convictions, doesn't it?
