Cross Examination during a Massachusetts OUI Trial

What is Cross-Examination?

Cross-examination is the process of challenging the testimony of a witness presented as evidence. When a lawyer calls a witness to present his or her testimony, this is known as direct examination. The opposing lawyer is also allowed to question the same witness in what is known as the cross-examination.

In a Massachusetts OUI Trial, typically the most important evidence that the state has against you is the testimony of the police officer. Therefore, it is vital that I am able to raise reasonable doubt about the evidence to which the officer testifies.

I typically cross examine the officers testimony on many of the following areas, as they apply to the specifics of the case:

Police Officer Background & General Info

My Client's Driving

Pre-Exit from Vehicle

Field Sobriety Tests

Booking & Arrest Process
  • Booking
  • Booking Videotape evidence
  • Was my Client Polite and Cooperative?
