Gathering
Evidence - the follow are some examples of types of evidence I will
study and analyze in preparation for a DUI trial:
- Police Report
- Booking Video
- Visit site of arrest with client - Videotape and photograph
- Investigation of Witnesses

Court Procedures - The following court procedures are used to
further gather evidence in preparation for a Massachusetts DUI trial:
- File Pre-trial Motions (Motion to Suppress under 4th or 5th Amendment,
Discovery Motions)
- Motion to Suppress Hearing
- Jury Questionnaires
Customized Preparation - After careful examination of all the
evidence against you, I will prepare a defense to refute what I expect the
state to present as the facts relate in your case, and to raise reasonable doubt.
- Opening Statement - I lay out the case for the jury, explain what
happened. One of the main goals is to put the jury in your shoes, so they
understand that you are a regular person just like them, and not a
"criminal", and how being stopped and arrested could have happened to anyone
with a little bad luck.
- Cross-Examination - Detailed breakdown
of the events, and all the things you did well.
- Closing Statement - Wrap up the facts, and point out any conflicting
statements the police officer made in his cross examination that suggest you
are not guilty.
